(Ecuador) For several years, the Huaorani people, aided by the Confederation of Indian Peoples of the Ecuadorian Amazon (CONFENIAE) have been working on delimiting and legalizing the lands which have historically belonged to them. On April3, the President of Ecuador, Rodrigo Borja granted, in his words, "612,000 idle hectares" to the Huaorani. 18 Huaorani community leaders traveled to Quito to receive title to their lands in a ceremony held in the Presidential Palace. The ceremony was imbued with political propaganda: "Under my government, you are free men and no longer slaves of anybody or thing .. .including dogmas of agitators interested in using you as a political instrument. .. " The small print on the land titles given by the Institute for Agrarian Reform and Colonization explains that the Huaorani "are not allowed to interfere with mineral and oil exploitation by the national government or authorized individuals." These conditions make it very clear that the Ecuadorian government intends to continue the exploitation of oil and other natural resources on Indian lands. This perpetrates the colonial I (Ecuador) On June 4th,1990, the Confederation of Indigenous Nationalities of the Ecuadorian Amazon (CONFENIAE) and lawyers of the Sierra Club Legal Defence Fund (SCLDF), together with the Inter-American Commission on Human Rights, filed a petition in which they charge the Ecuadorian Government with "the endangerment of the lives and culture of Ecuador's Huaorani people through the encouragement of oil development on the Huaorani's traditional lands." Voi5Nos3&4 policies of disrespect for Indigenous peoples and their rights to decide their own destiny. The grand political propaganda that accompanied the ratification of the land entitlement, shows how the government is trying to change its negative image in respect to the destruction of the natural environment and the negation of Indigenous rights. Neither CONAIE (the Confederation of Indigenous Nations of Ecuador) nor CONFENIAE were invited to the ceremony. Ayuma Tenko, representative of the Huaorani people, upon receiving the ownership titles, commented: "This ratification of our territory is not completely your will. It is the product of years of struggle by our people, of national organizations and of national and international solidarity. Furthermore, Mr. President, we ask that you immediately stop the construction of roads in our territory, that you evict the colonizers that have invaded our lands and the oil companies that are destroying our forests. Someday we will have nothing. If you do not meet our demands, we will defend what belongs to us with our own spears." I II II •• CONOCO Ecuador, Ltd, a "wholly owned subsidiary of Dupont, plans to build more than 100 miles of roads and pipelines, as well as dozens of oil rigs, pumping facilities and housing for several hundreds workers" with direct encroachment on Huaorani lands. 13 �About 1,600 Huaorani people live by hunting and shifting cultivation, and are among the most isolated groups of the Amazon rainforest. CONFENIAE president, Luis Varga tragically sums up what the "developers" will bring to the Indian population: Forced employment or unemployment, a loss of the natural resources which guarantee Indian subsistence, as well as general contamination of their environment, the introduction of prostitution, alcoholism and infectious diseases, the destruction of traditional healing methods and natural cures, and the assimilation into a destructive, consumerist society. Furthermore, the abuse of Indigenous people goes hand-in-hand with the destruction of the Amazonian rainforest. Members of both CONFENIAE and SCLDF emphasize how the interests of Indigenous people and conservationists coincide. "By assuring the respect and protection of Indigenous rights, the environment will automatically be protected. On the other hand, efforts to protect the Amazon which do not actively include Indigenous people and elicit their sincere support are doomed to fail." Members of CONFENIAE warn us not to fall prey to governmental demagogic discourse which buries ecologically destructive practices in ecological rhetoric. National parks, forest reserves and protected areas have 14 not meant the protection of the environment in Ecuador, but rather have become new areas for colonialialist exploitation and environmental destruction. The Yasuni Park is a good example of this. Oil exploration and drilling has been frequently conducted within it's borders by CONOCO. Recently 200,000 hectares of Yasuni Park land was granted to CONOCO. The Department of National Forestry has developed a plan in conjunction with CONOCO, by which more than 50% of the total area of the park will be opened to petroleum and mineral operations. The World Bank has been financing oil development in Ecuador and a new loan of $100 million is pending. Ecuadorian Government Grants New Concessions to Oil Companies The government of President Rodrigo Borjas will grant new concessions to oil companies operating in the Ecuadorian rainforest as well as on the coast. Oil development in Ecuador is controlled and monitored by the Ecuadorean State Petroleum Corporation (CEPE). Approximately 630,000 hectares of fragile rainforest and coastal regions are being exploited by oil A new round of concessions is expected before 1990 in the next international bid. The New Oriente Concessions will total more than 2,500,000 hectares and include lands in Huaorani Indian territories, as well as lands in Yasuni National Park. Conoco, a U.S. based company, and one of about 20 international petroleum corporations currently operating in Ecuador, is planning to build a 175 kilometer road which will serve to build and maintain an oil pipeline. This project has met with serious opposition nationally from Indian organizations (particularly CONFENIAE), and criticized by many �international environmental groups. (see SAIIC newsletter, Fait 1989). The Sierra Club Legal Defense Fund, based in San Francisco, California, has been circulating a 39 page report about oil road construction through Ecuador's YasuniNational Park. The report received particular attention at the UN Session for the Prevention of Discrimination and Protection of Minorities last August in Geneva, Switzerland. The report states that "the already severe reduction in the Huaorani population because of similar activities in the past is well documented and is notice of the threat of genocide of the Huaorani people if the road and other encroachments occur ... Both Ecuador and Conoco, as joint organizers of the oil exploration in Huaorani territory, could be liable for genocide." (pp.1718) CORDAVI, a human rights legal defense group in Ecuador, has presented a similar case against the construction of the road, alleging that the "Ecuadorean government violated the constitution by allowing the construction of the road and the exploitation of resources within a protected area." Last May, representatives of the Ecuadorean government, CEPE, and the Ecuadorean Institute of Agrarian Reform (IERAC) and representatives of CONFENIAE and the National Organization of Indian People in Ecuador (CONAIE) signed an agreement at Sarayacu, an Indian community in the rainforest. The legal authorities committed to legalizing Huaorani Indian territories as protected areas, as well as other Indian territories, under the coordination of CONFENIAE. They also agreed to stop the colonization of Indian territories in the rainforest and on the coast, and to require the withdrawal of the Sumner Institute of Linguistics from Indian territories. As of today, the government has not complied with any of the agreements. CONFENIAE reports that "the situation in the Ecuadorian rainforest today is extremely alarming. Of the approximately eleven million hectares of rainforest, 35% is under private occupation by plantations, cattle ranches, and other forms of agroindustry. Only 15% has been declared national parklands. Overall, 80% of the region is held by private companies which have been known to destroy the forest under the system of' conces- �sions.' For that reason, we, the Indian people are standing up to defend our territory and to preserve the ecosystem of the Amazon ... " Oil Companies Destroy Quichua Sacred Site SAIIC coordinator, Nilo Cayuqueo together with international lawyer, Karen Parker of the Sierra Club Legal Defense Club visited Ecuador from July 7th to the 21st to meet with representatives of CONFENIAE (the Confederation of Indian Nationalities of Ecuador). The purpose of the visit was to discuss possible international legal actions to take against the Ecuadorean Government and the international oil companies, primarily a division of the U.S. company- Conoco, operating in the Ecuadorian rainforest. The following interview took place in Block 10 of the Sarayacu River where the U.S. oil company Arco, and the French exploration company CGG, are operating in the Ecuadorian Amazon. "My name is Juan Sanchez Pena. I am over 50 years old and I have lived in this community of Sarayacu [which means River of Corn in Quichua] all my life. My parents and my grandparents and all my ancestors were from here also. We, the Quichua people from the Amazon region of what is now called Ecuador, were living here peacefully. We have had enough food - yuca, corn, different types of potatoes and fruit. Here, in the Amazon, we have many rivers and are able to fish. Every family has a canoe to travel on the rivers, to fish and to visit friends, and to go to ceremonies and fiestas. When a young couple or anyone needs a new canoe, we hold a 'minga' [communal work party] to construct it. When we need meat, we go hunting. We, the men, do that and the women wait for us and when we return, we have ceremonies and a big party. We used to have a lot of animals to eat here, but now the situation is different and sadly, it's getting worse all the time. A long time ago (around 1943-45), people came with heavy machinery. They came and without telling us anything, they started to make big explosions. We did not know what was going on! Later, we found out that they were exploring for petroleum. After analyzing recent conflicts between Ecuador and Peru, we declare the following: In the countries of Latin America and around the world and, particularly among countries which are in conflict, we comprise a diversity of peoples and cultures which are historically located in our own territories. The border conflicts that today lead to bloodshed in neighboring populations and destroy their harmony and lifestyles, are not in our interests. Rather, they have lead to a stalemate and a deepening poverty for the communities involved. For these reasons, we Indigenous nationalities propose: That Ecuador be constitutionally recognized as a pluri-national, multicultural, and plurilingual state, because the recognition of and respect for different peoples is not an obstacle to the unity of a diverse country, but rather a resource that will strengthen its cohesion. In homage to the International Decade of Indigenous Peoples that the United Nations declared, we demand of International organizations and the guarantee nations of the Rio Protocol that Indigenous peoples in Ecuador and Peru be included in the peace negotiations as active participants in the search for a definitive solution to the conflict. That the Ecuadorian State permanently suspend the colonization programs in the ancestral lands of the Indigenous nationalities of the Amazon Region. The legalization of Indigenous territories in the border area and in the Amazon Region as a fundamental guarantee of the security and territorial integrity of the country. That the National Parks, Protected Forests, and Forest Reserves be given to and administered directly by Indigenous organizations for the appropriate use and management of their natural resources, That we be repaired for the socio-economic and environmental impacts caused by the war; a guarantee of the return of displaced peoples to their Indigenous communities; and the establishment of a fund for the relatives of civilians killed in the conflict. For this reason, we have dedicated this edition to publicizing Indigenous thinking and discussion on nation-state border issues. The 1995 war between Peru and Ecuador has rekindled interest in this ongoing debate. Reminiscent of the formative nineteenth-century nation-state independence wars in Latin America, this recent war is a bloody conflict between nation-states fought with Indigenous lives. Twentieth-century examples of similar situations include the 1932-1935 Chaco War between Paraguay and Bolivia which took 40,000 Indigenous lives, the so-called Soccer War in 1968 between El Salvador and Honduras, the never-ending strife on the Colombian-Venezuelan border, and the hardships which the Miskitu people in Nicaragua and Honduras and the Kuna Nation in Panama and Colombia have endured. European colonizers first, and then American States, delineated borders. Outsiders divided the continents' geographical space and states, provinces, departments, municipalities, and counties replaced cultural territories of Indigenous origin . The Spanish Crown, after decimating and exploiting Indigenous peoples, decided to give some territorial rights through the systems of "Mercedes lndivisas," "Cedulas Reales," and other communal rights. Indigenous peoples exercized autonomous rights to those territories. However, after the Criollo (descendants of Spaniards) elites expelled the Spanish monarchy in the so-called War of Independence, they took away those territorial rights, and imposed on Indigenous peoples a new ideology of "citizenship." Indigenous peoples were forced to enroll in the Criollo Independence Army. Needless to say, they were used as cannon fodder. The new governing elites decided that it was their turn to rule the vast territory which is today America. The Criollo elites reshaped, according to their individual interests, what today are considered the Latin American states. Indigenous peoples were not consulted to evaluate that process. With our populations decimated, borders were imposed on us, subdividing our Indigenous nations. Although the decline of the Spanish empire and the emergence of the Criollo elite ushered in the recognition of some of our own traditional territory, Indigenous "uprisings" throughout the nineteenth and twentieth centuries were constant reminders of the denial of our immemorial rights to our own territories which we have occupied for thousands of years. New legal systems based on individualistic Roman judiciary tenets contradicted the collective cultures of Indigenous peoples. Today, the Latin American states continue to deny and ignore Indigenous peoples' conception of justice and government. Today, the Indigenous movements demand to be heard. It is important that throughout this Decade of Indigenous Peoples our different conceptions of political rights to self-determination and autonomy be reexamined. Our cultural practices and our reproduction as collectives requires having control over our territories. We are more conscious about the need to be heard as "collective entities." Indigenous peoples' demands need to be heard and met by new rules that cannot be defined by westem laws and cultures. It is imperative that governments and societies recognize our rights as distinct and original peoples of the world. Borders are but one of several obstacles we face as Indigenous peoples. Each demarcated border line has been created by the process of colonization and violence against Indigenous nations. Whether domestic or international, borders bear the same colonial logic. Ultimately, they mean our demise. In light of this fact, the articles in this issue will update the tremendous pressures we must face due to anachronistic colonial legal structures, by now obsolete, that deny us our rights as original Indigenous peoples. Mexico internationally recognized as a stable. peaceful and democmtic country, proud of its government and admired by others. finally stood revealed. The uprising showed the world what many of us already knew: the extreme exploitation, oppression, discrimin:uion and misery of the close to fifteen million Indigenous people that live there. We also know that the same conditions exist in the maJonty of the countries on this comment. We hope that the eventS in Chtapas cause to renect not only governmentS but also the so-c~lled national societies which ha,·e generall>• remained indifferent to lndtgenous demands--so that this indifference is recogmzed as complicit)' with injustice. GovernmentS and societies ill general cannot commuc to ignore the clamor for justice being made by our people. In the meantime. Indigenous people are creating the necessary strateg)' and ideology to see more clearly our road to liberation . and to avoid confusion in the sense that Indigenous aspirations are reduced only 10 cia~ or economic demands. We want to clarify that Indigenous demands arc not just for a bcuer salary, or a piece of land, rather they oriented towards reconstructing our communities and cultures. In the last edition of Abya Yala News. we noted that even though some anent ion had been given to Indigenous problems by governments, institutions, and non-governmental organizations. little justice was actuallr achieved. Nonetheless, and despite everything. there are positive signs which hold out hope for a beuer future. We can affirm that Indigenous peoples continue to develop and communicate their objectives and policies wuh increasing clarit)' and unity. The International Year of Indigenous Peoples declared by the United Nations m 1993 created many expectations. But with few exccpuons, and despite the good intcnuons of some international agencies and go"ernments such as those of Norway, Canada and Australia,linle has changed. Not onl)•do Indigenous demands continue to be demcd. but the S)>Stematic violation of our peoples' human rights continues. Repression, murders. forced displacements and indiscriminate natural resource exploitation are the continuation of work begun five hundred years t~go. The United Nations has now declared this the decade of Indigenous Peoples. It is likely that governments with use this declaration todivett anent ion from existing problems, with the usual paternalistic propaganda. The difference is that now, Indigenous peoples scrutinize government policies. We are beuer organized and have more experien~e. The current challenge for Indigenous organizations is create the necessary strategies for change and a solid continental unity. Indigenous delegates to the UNs Working Pro-!!p on Jndtgen~us l'llpulatlons p roposed that 1992 be declared the Year of Indigenous Peoples as a gesture of reparation for 500 years of colonization. Covernmental representatives at the UN refused. ~ / supporting Instead Spain's proposal to commemorate 1992 as the~ncounter ofTwo Worlds", whlle agreeing to declare 1993 as the Year of Indigenous Peoples. ';. , The Inauguration of the Year oflndlg~nous Peo~les took place on December 10. 1992 (see article page 4). It was the first time that Indigenous representatives were Invited to speak to the UN's Gel)eral Assembly. Indigenous delegations from all over the world made great efforts to travel to New York for th.l s event at their OWn expense. since no UN funds were provided for this purpose. After the UN officials and government representatives addressed the Cene?J Assembly In the morning. the meeting was to continue In the afiemoon with the speeches of the Indigenous ';'P~nta~es. { et when the Ceneral Assembly reoonvened. the Indigenous represen tatives wilnessed, with great surprise and.~dJsOlusloni'Oent, that almost all of the government representatives and many of the UN officials had left. Many took this as a bad augury for the "lntemauonal Year of Indigenous Peoples", as well as a sign of great disrespect. These tnausplclous begtnnlngs have yer to be overcome. FIVe months afier the tnaugurauon tn New York, the many promises of 'Working tn partnership" with Indigenous peoples have stW not been fulJlUed. For example, the Center for Human Rights In Geneva has announced that they have obtained several hundreds of thousands of dollars for Indigenous Peoples' Projects. but they have not yet consulted wilh any Indigenous organizations In order to decide what projects will be funded. Indigenous peoples have not been granted official partlclpa,Uo~ at t4e upeomtng World Con ference of Human Rights tn VIenna. The ILO's Convention 169 has not yet been ratified by the majority of the world's nation-states. WhUe the Oral\ Declaration of Principles and Rights of Indigenous Peoples may be approved afier 10 years of development (see page 5). It will then sun need to be approved by the Human Rights Commission and ratified by the many governments represented tn the UN before betng adopted bY the Ceneral Assembly. Whlle It Is certatnly both worthwhile and necessary to strugg)e for the establishment of these tntemaUonal accords and then to ensure that governments act In oompUance with them - It ts Important that this not replace the energy and attenuon that we need to gtve to slrengthentng our communities and organl2aUons. SAIIC funciona en California, Estados Unidos, su Consejo Directivo está formado por indios de Centro, Sud y Norte América. Contamos con la solidaridad y colaboración de numerosas personas y organizaciones indias y no indias. Uno de nuestros objetivos es el de informar a nivel internacional sobre las violaciones a los derechos de los Pueblos Indios, sobre los esfuerzos de autodeterminación y autodesarrollo de nuestras comunidades y sobre las actividades de las organizaciones indias. Los Pueblos Indios enfrentamos el racismo y la discriminación, la usurpación de nuestras tierras, los intentos de aculturación y asimilación, la violencia y la represión, la destrucción de nuestro medio ambiente; en fin, todas las formas posibles de exterminio cultural y físico. Pero también, hoy en día, la resistencia de los Pueblos Indios a la invasión y colonización se fortalece, nuestras organiciones crecen, como crece nuestra conciencia y el compormiso de preservar nuestra identidad, forma de vida, cultura e ideología. A la vez, desarrollamos nuevas formas de lucha y forjamos alianzas con los oprimidos y con aquellos sectores preocupados por el futuro de la humanidad. La voz del indio se escucha en los foros internacionales, manejamos los medios de comunicación occidentales y nos constituímos en una fuerza movilizadora dentro de los estados coloniales. Los Pueblos Indios recuperaremos el control sobre nuestra vida y nuestro futuro para poder legárselo a nuestros hijos. Como indios de Centro y Sudamérica, es importante que estrechemos lazos de unidad con nuestros hermanos Indios del hemisferio Norte, quienes sufren como nosotros el colonialismo y la opresión y con quienes compartimos una misma ideología, basada en la armonía con la naturaleza y el espirítu comunitario. Es necesario estrechar filas con aquellas personas y organizaciones que nos ofrecen su solidaridad para con la causa india, y que saben respetar nuestra autonomía de acción y pensamiento, aquellas personas que han comprendido que La Madre Tierra es una y lo que le sucede a uno de sus hijos nos afecta a todos. Al alcanzar los ocho años de existencia podemos decir que nuestros propósitos fundamentales --el de ser un vehículo de comunicación entre los pueblos indígenas de Sur, Meso y Norteamérica, y el de difundir y apoyar el trabajo de las organizaciones y comunidades del Continente-se están cumpliendo. A los 500 años de invasión europea, el movimiento indígena continental se está consolidando, cumpliendo así la profecía indígena de la unión del Cóndor y el Aguila. La lucha histórica por la autonomía y la justicia de los pueblos indígenas, basada en la autodeterminación, es una meta clara en la mente de nuestros pueblos. La conmemoración de los 500 años de invasión europea nos permitirá dar a conocer al mundo la existencia viva de los pueblos indígenas, reconstruyendo nuestras Nacionalidades en unidad y por siempre. Aunque se han logrado algunos reconocimientos de los derechos indígenas estos no son definitivos triunfos. El camino hacia la justicia y la autodeterminación es aún largo. Reconocemos que la alianza con otros sectores es importante. Por ejemplo, la. concientización de ambientalistas ha sido importante, pues con ellos tenemos alianzas concretas, para respetar la vida de nuestra gente y evitar la devastación de nuestros territorios. La alianza estratégica y coyuntural con los sectores populares no se ha dado aún en igualdad de condiciones, primeramente porque el movimiento popular (llámese de izquierda) continúa con el dogmatismo y la mentalidad colonizante de que la causa indígena está fundamentalmente inscrita en la lucha de clases, y que los "problemas de las etnias serán resueltos después de que se haga la revolución". Estos intentos de negar los valores y derechos históricos de los pueblos originarios de este continente, a decidir su propio destino, atentan contra nuestra unidad. La Conferencia Continental de la "Campaña 500 Años de Resistencia Indígena y Popular" que se llevó a cabo en Guatemala del 7 all2 de octubre de 1991, mostró claramente el interés de la dirigencia de los sectores populares, que sacando provecho político para sus propios movimientos o partidos, negaron las legítimas aspiraciones de igualdad de los pueblos indígenas. Varias delegaciones Indígenas presentes en la conferencia, demostrando madurez política en esa reúnion de Xelajú, separadamente vieron la necesidad de convocar a la reunión Continental India de Coordinación en Panamá del 19 al 21 de diciembre de 1991, reunión que se llevó a cabo con mucho éxito y amplia participación, y de la cual informamos separadamente. Independientemente de las alianzas coyunturales que se den en cada región, creemos que la unidad continental indígena será ahora, como se acordara en la reunión de Panamá, una de las prioridades fundamentales para el movimiento indígena. De esa manera se estrecharán los vínculos históricos que fueron cortados por la colonización. Esto ayudará a formular una propuesta global indígena al resto de la sociedad. Es muy importante la creación de una sólida red de comunicación entre los pueblos indígenas a nivel continental y con las organizaciones internacionales de solidaridad, organizaciones de apoyo financiero y técnico. En muchos casos las organizaciones indias no los utilizan por falta de información sobre la existencia de tales recursos, o porque se carece de algún tipo de capacitación administrativa para recibir fondos económicos. Por años, cientos de organizaciones de apoyo llamadas ONGs, siguen recibiendo fondos para "trabajar con indígenas". No estamos contra el apoyo técnico o solidaridario que muchas organizaciones prestan, pero hay que reconocer que muchas ONGs hacen del "apoyo a los indígenas" un medio de vida. En muchos casos, los recursos que reciben provocan divisiones al interior de los pueblos originarios, pues trabajan con aquellos indígenas que están de acuerdo con sus políticas o formas de trabajar. Es importante que las Organizaciones indias hagan sus propios proyectos, se capaciten técnicamente y tengan el acceso a la información. La organizaciones de Talleres Regionales de capacitación e información, como se acordó en la reunión panindia de Panamá, son muy importantes. Todo este panorama continental demuestra claramente que la lucha de los pueblos indígenas hacia la liberación no es fácil. Es ya irreversible el proceso de resurgimiento de los movimientos indígenas. Estos procesos irreversibles, de nuestra toma de conciencia alientan la esperanza de un futuro mejor. Los artículos de este número hablan de la necesidad contfnua de reforzar, de repensar estrategias: y de promover la sabiduría esencial de nuestro ancestro para así dirigimos a los próximos 500 años.
