Dicha ley fue formulada bajo el espíritu de establecer un nuevo proceso de regulación del uso de la tierra. Los datos estadísticos sobre la tenencia de la tierra en Bolivia revelan dos imágenes problemáticas: la sobre-concentración de tierras arables en pocas manos, y la ineficiencia de la agricultura de subsistencia en los minifundios. Siguiendo el fraccionamiento agrícola boliviano, la agricultura moderna de corte capitalista se encuentra en la Amazonía; las tierras menos productivas de subsistencia se hallan en la franja andina. Esta división ecológica se tradujo también en la división del movimiento indígenacampesino que-en ambos modelos-sufre de una profunda pobreza económica. La Gran Marcha presionó al gobierno para modificar la ley conocida por INRA [Instituto Nacional de Reforma Agraria] en respuesta a la ausencia de un método confiable y apropiado que regule el uso de la tierra. Es importante anotar que la Reforma Agraria boliviana fue bruscamente detenida ya hacia los años setenta, convirtiéndose en un organismo que sufrió altos niveles de corrupción. Los indígenas y campesinos por su parte estuvieron organizados en tres organismos: la CIDOB (Central Indígena del Oriente Boliviano), la CSCB (Confederación Sindical de Colonizadores), y la CSUTCB 26 y TERRITORIO (Confederación Sindical U ni ca de Trabajadores Campesinos). Esta última agrupa al menos un millón trescientos mil personas y; entre las tres, un total de un millón ochocientos cuarenta y cinco mil indígenas, campesinos y colonizadores. En una entrevista sobre los recientes acuerdos, el Vicepresidente aymara Víctor Hugo Cárdenas dijo de la aprobación de las modificaciones: «Todo está dirigido contra el neo-latifundio improductivo». Por otro lado también dijo: «La Ley frenará el proceso de acaparamiento latifundista y dará seguridad jurídica a todos los productores del campo, pequeños, medianos y grandes, y titulará con tierras comunitarias de origen a una veintena de pueblos indígenas». Sin embargo, el gobierno sólo ofreció tocar lO millones de hectáreas, mientras que según las demandas de indígenas y campesinos, se necesitarían al menos 60 millones de hectáreas. No obstante, el gobierno piensa haber atendido gran parte de las demandas de indígenas y campesinos. El ministro de la Presidencia, Guillermo justiniano, declaró que, «Aunque parezca mentira, no hay datos precisos para saber cuánta tierra está en manos de grandes terratenientes y cuánta realmente en manos de pequeños. En términos generales podemos admitir que hay una elevada concentración de tierras en pocas manos» (Presencia, 6 de Octubre, 1996). Según el analista Raúl Prado, «La aprobación de la Ley INRA siguió el camino de las otras leyes promulgadas por el gobierno: ausencia de consenso e imposición.» Según él, la Ley INRA favorece indirectamente a los grandes empresarios, imponiendo dificultades de probar su viabilidad económica a los indígenas y campesinos, para mantener legalmente la propiedad de la tierra: no sólo es importante tener la tierra, sino también producirla y erogar impuestos. Señala, sin embargo, que todas las Federaciones Departamentales y Centrales provinciales fueron instruidas a organizar marchas para tomar y ocupar tierras húmedas del Oriente boliviano, como mecanismo para garantizar la dotación. Originally, Jamaica was colonized by the Spanish, who used the indigenous Arawak name for the island, Xaymaca, and enslaved the Arawak people. The Arawaks, known as a peaceful people, soon began to die of starvation, disease, and overwork, so the Spanish began to import slaves from the west coast of Africa, including Akan, Ibo, and Mandinka. In 1655 the British invaded the island, and the Arawaks, Africans, and Spanish took to the interior hills to fight them, each for different reasons, of course. Finally, the Spanish gave up and fled, but the Arawaks and Africans continued fighting and became known as the Maroons, from the Spanish word cimarrones, meaning domesticated cattle that would escape and become wild and unmanageable. There is no written history of the time from the Maroons' point of view, but from oral history it is known that the Arawaks and Africans helped each other. The Arawaks knew the land and taught the Africans what they knew. They intermarried and, under the leadership of Colonel M. L. Wright of the Accompong Maroons Nanny, a guerrilla woman and spiritual leader, playing the gumbe drum. the Maroons made a peace treaty with the British in 1739, winning the right to freedom, self-government, and land. Music is an integral part of the Maroon culture. One of the most honored instruments is the abeng, which is carved from the horn of a cow. The abeng, which only plays two notes, was used to communicate from hillside to hillside during the war, and it has a language that to this day is known only to the Maroons. It is never used for entertainment and is only blown freely at Christmas. One Maroon song is said to have been sung by Nanny after the Treaty of 1739 to urge the Maroons to unite and obey the treaty: What a wonderful people behave o yo Many bloods behave o people This Nanny has called for. According to the newspaper /ere, Carib representatives from Belize, St. Vincent and Dominica met in the spring in Dominica and called for more governmental recognition of Carib culture and identity. Like the Maroons in Jamaica, Caribs are descended from Indians and Africans who banded together in resistance to colonial European society. Caribs living in Dominica maintain a local government Carib Council headed by the Carib Chief, who is elected directly by the people, according to tradition. However, the representative from St. Vincent at the conference spoke of the lack of such structures on his island and expressed concern about the disappearance of the culture of St. Vincent's estimated 5,600 Caribs. Para convertirse en ley, este proyecto tendrá que ser aprobado por la Cámara de Diputados y por el Presidente de la República. Si es aprobado, la propuesta pondrá el ya demarcado territorio Yanomami en riesgo de ser reducido. la propuesta amenaza no solamente a los Yanomami, sino a todos los indígenas de Brasil. Esta propuesta es apoyada por grupos económicos interesados en la explotación de los recursos naturales en territorios indígenas, también como por ciertos sectores militares que insisten en que los territorios indígenas en las zonas fronterizas amenazan la seguridad y la soberanía nacional. Esta propuesta del senado es un obstáculo más que se adiciona al ya lento proceso de demarcación de los territorios indígenas en Brasil. Según el proyecto , las demarcaciones futuras requerirán de la aprobación de el Congreso Nacional. Provisiones adicionales requerirán que el presidente consulte con el gobierno del estado en el cual el área indígena es propuesta. E De CIMI (Consejo Indianista Misionero) Comisión lnteramericana de Derechos Humanos visita Ecuador on el objetivo de investigar la situación de los derechos humanos de los indígenas del Ecuador en relación al desarrollo de la explotación petrolera en el Amazonas, la Comisión Interamericana sobre Derechos Humanos de la Organización de Estados Americanos, OEA, visitó Ecuador entre el 7 y el 11 de noviembre de 1994. Además de reunirse con las autoridades del estado de Amazonas, la Comisión se reunió con organizaciones indígenas, ambientalistas y de derechos humanos. Y por una hora se reunieron exclusivamente con representantes de CONAIE, CONFENAIE, COICA, ECUARUNARI, FICI, FOIN y ONAIE. Después se desplazaron al oriente en donde se reunieron con representantes de las organizaciones de base y con líderes de los grupos Cofán y SionaSecoya y constataron el tremendo impacto producido por el desarrollo petrolero sobre el medioambiente y las comunidades indígenas. La comisión además se reunió con un grupo de Huaoranis de la región de Napo quienes hicieron un reporte sobre la contaminación del área y sobre los con- C 4 flictos con colonos en su territorio. Al finalizar la visita, los representantes de la Comisión ofrecieron una rueda de prensa para hacer pública la situación y catalogaron los hechos como violaciones al derecho a la vida y al bienestar. Aunque el objetivo de la visita era investigar la situación de derechos humanos en Ecuador, la situación de los pueblos indígenas en relación a la explotación petrolera fue uno de los dos temas prioritarios (el otro fue el tratamiento de los prisioneros). La intervención de la Comisión en el Ecuador ayudó a asegurar que los indígenas afectados tengan el derecho a ser adecuadamente informados y a participar en los procesos de toma de decisiones concernientes a la explotación petrolera. Indígenas del Perú También Demandan a Texaco l29 de diciembre de 1994, una demanda colectiva fue hecha en la Corte Federal de Nueva York en favor de 20.000 indígenas que viven alrededor del río Napo en el noreste de la Amazonía Peruana. La demanda afirma que las acciones de Texaco en el Napo afectaron severamente a los pueblos indígenas. Además de repetidos derrames de petróleo Texaco abandonó en la zona enormes cantidades de químicos tóxicos. Texaco rechaza la acusación, pero ha incrementado su defensa desde que un juez de los Estados Unidos, en una decisión sin precedentes, adelantó un caso en contra de la compañía iniciado por los indígenas del Ecuador en abril de 1994 y después del cual la compañía fue encontrada responsable de graves daños ambientales en la Amazonía. Según estimativos del gobierno ecuatoriano, 16.8 millones de galones de residuos de crudo y petróleo fueron derramados por Texaco en el área del Amazonas donde adelantaban la explotación y una porción desconocida fue transportada por los ríos hasta el Perú. En 1992, la parte peruana del río Napo fue inundada con crudo. El Departamento de Energía de los Estados Unidos y un potencial receptor de desperdicios, La Oficina de Energía Atómica de Canadá, están considerando la construcción de un depósito permanente de energía nuclear en la reserva Cree del lago Meadow, que cubre el área norte de Saskatchewan en Canadá. Las dos tribus están trabajando en un acuerdo a través del cual la reservación de Mescalero podría servir como depósito temporal de los desperdicios nucleares generados por actividades comerciales de Estados Unidos y como comisionados para los desperdicios nucleares exportados a la reserva del Cree. El Tratado de Libre Comercio del Atlántico Norte (NAFTA) ha abierto el camino para el embarque de desechos nucleares. En el acuerdo, el combustible irradiado (radioactiva) no está obligado a pagar tarifas, permitiendo su embarque a Canadá. Todo lo que se necesita ahora es el acceso, temporal o permanente, a lugares de almacenamiento. La comunidad "Aurora 8 de Octubre" había mantenido una actitud ejemplar de reconciliación. Las tierras que obtuvieron para su retorno estaban ocupadas por indígenas y campesinos sin tierra. 36 La masacre es una clara violación de los acuerdos del S de octubre, 1992, los cuales garantizan un retorno pacífico y en seguridad a los refugiados en México, y de acuerdos internacionales sobre derechos humanos, como la Convención Internacional en Contra del Genocidio. También, este hecho tendrá un impacto muy fuerte en el proceso de negociación entre las fuerzas revolucionarias y el gobierno, ya que el mensaje de la masacre es que los retornados no pueden esperar la paz y seguridad en Guatemala. Las condenas de este hecho de genocidio han llegado de todo el mundo. Una marcha patrocinada por la COPIN (Coordinadora de Pueblos Indígenas de Intibuca) en Honduras el 11 de octubre reunió a 400 personas indígenas en la capital, Tegucigalpa. Bautizada como "peregrinación por la paz y el respeto de los derechos humanos," los indígenas se reunieron frente a la embajada guatemalteca. El líder lenca de COPIN, Salvador Zuñiga, declaró que lo ocurrido a los "hermanos guatemaltecos es horroroso, viola los derechos humanos y nosotros como pueblos indígenas identificados con estas causas, queremos solidarizarnos y exigir justicia." Por su parte, Rigoberta Menchú llamó al inicio de procesos legales dentro del gobierno y recomendó la pena capital a los responsables. El Ministro de Defensa, Gra. Mario René Henríquez Morales, renunció su cargo el lunes 9 de octubre "como una contribución para ayudar el gobierno para que resuelva esta situación y para ayudar a la institución militar." El jefe de Estado Mayor de la Defensa, Gral. Marco Antonio Gonzalez Taracena, amigo personal del presidente Carpio, reemplazó al general Enriquez Morales. Sin embargo la represión y la negación total de los derechos humanos en la población rural indígena en Guatemala ha de continuar si no suceden profundos cambios dentro de la estructura político-estatal-militar del país. Protestan que estas acciones están en violación de convenios internacionales y leyes nacionales,entreelloslosarticulos4.l, 7.1, 7.3, 7.4, 13.1, 14.2, 15.1 y 15.2 del Convenio 169 de la OIT, ratificado en Honduras en 1995. Masacres Paramilitares en Pueblos Indígenas Colombianos La Organización Nacional Indígena Colombiana (ONIC) acusó que el día 8 de junio al menos 20 personas fueron asesinados y 18 más desaparecidos por grupos paramilitares y dirigido por el ejército entre el2 7 y 29 de mayo en los pueblos de La Isla, Guaguas, Canal y Bartola, en la selva de Murindo en la región noroeste de Uraba, Colombia. Otras 500 Indígenas AfroColombianos y Embera-Katios han escapado del área por la violencia. El día l l de junio, diez miembros de un grupo paramilitar entraron a la comunidad de El Diaz del Pueblo Indígena Embera Katio, en el departamento de Choco. Mataron a dos jóvenes, y amanezaron a los demas 350 habitantes salir de la comunidad durante 24 horas o morirían. Amnistía Internacional está mandando al gobierno Colombiano investigar todas las matanzas y violaciones de derechos humanos contra los Indígenas, y que cumpla su compromiso de combatir y desbandar los paramilitares que prometió en 1989. Movilización Mapuche El lunes l3 de Abril, las comunidades Mapuche de Pangueco y Soto Cariqueo, de la comuna de Galvarino empezaron la recuperación de tierras que fueron usurpadas por particulares y empresas forestales. Veinte familias de la comunidad permanecían en el predio para reclamar como suyas 444 hectáreas. Otras cincuenta personas .de la comunidad Soto Cariqueo hacían ocupación de 300 hectáreas de la Forestal Mininco, para reclamar derechos históricos sobre esa zona. Segun las comunidades Mapuche, ellos decidieron permanecer en las tierras hasta que autoridades de la Conadi, de Intendencia o Gobernación, se acercaran al terreno a conversar. Estos eventos coincidieron con la visita a Temuco de la primera dama de Estados Unidos, Hillary Clinton. Las comunidades Indígenas aprovecharon esta visita y presionaron al gobierno a dialogar. According to the Comite Campesino del Altiplano (CCDA), there was strong evidence implicating the Guatemalan military in the massacre. On November 17th, between 2:00 and 3:00am, Army soldiers and National Guardsmen searched the homes of members of La Independencia Cooperative in Teotepequec, Department of La Libertad. After accusing the members of being communists and supporting the guerillas, they began to shoot, killing ten Indian people, among them three or four children. They were all members of ANIS, the National Association of Indian People of El Due to complete military control in the area, no journalists are being allowed to enter the area. Two members of the cooperative went immediately to ANIS headquarters in Sonsonate to report the killings. . The chief of ANIS, Adrian Esquino, is bemg threatened and reported as a "subversive" along with all members of UNTS the National Workers Union, on Radio Ku~catlan which is under military control. When approached by leaders of Krautara about why they were demarcating Tawahka lands, they responded that they had just bought all the lands upriver from Krautara. These lands had been cultivated and lived on by the Tawahka for centuries. The people of Krautara and nearby Krausirpe, through FITH (the Federation of Tawahka Indians of Honduras), responded immediately by taking up a collection, with every hou~e­ hold contributing to send a small delegation to solicit legal help from development organizations and lawyers in the populated Honduran interior. The Tawahka, Miskito and Pesch Indians live in the Northeast of Honduras, an area known as the Mosquitia. In total, more than 40,000 Indian people live there, with the Miskitos forming the vast majority. Their subsistence economy has allowed them to live in relative harmony with the fragile environment there, which has resulted in the conservation of some of the largest tracts of tropical rainforest in Central America. Many species of animals and plants which are extinct in other parts of Central America still exist in the Honduran Mosquitia. There were confirmed reports of 11 dead and 19 wounded. Other sources claim 26 dead and 71 wounded. By December 4,1990, three more wounded had died, bringing the confirmed total dead to 14. The evening of the massacre, soldiers entered the town, robbing a store and kidnapping its owner. Relatives of the shopkeeper woke other residents by ringing the church bells. When villagers heard the commotion, a crowd of 1500 gathered in the town plaza and proceeded to the Panabaj army garrison to protest the incident, shouting "Leave us in peace!" A short time later, the army opened fire on the crowd. 9 1/U ~ VoiS Nos3&4 1: Santiago Atitlan has been the site of massacres and continuous murders ever since the army permanently occupied the town in 1978. Mayor Delfino Rodas is calling for a rapid investigation into the massacre and f.') prosecution of those found responsible as IJ!..\ well as the removal of the army garrison r~ ~ from Santiago Atitlan. Referring to the army base, he states that "Instead of protecting us, it is they who, under the effects of alcohol, become the assasins of the residents of this area." The people of Guatemala have :; : 31 �expressed their solidarity with the people of Santiago Atitlan pn a huge scale. Many Indian, religious and human rights groups are demanding justice. The people of Atitlan are not allowing themselves to be intimidated and are coming forth to give testimony, in spite of repeated threats to their well-being. The military is emphasizing that the massacre was a "mistake committed by the officers and soldiers of the garrison." According to the Guatemala News, the massacre was no mistake, but part of a well-orchestrated plan to intimidate and hold back the growing tide of popular discontent. The 1978 massacre of over 300 farmers in Panz6s, Alta Verapaz, the killing of 39 political leaders in the Spanish Embassy in 1980 and the "scorched earth" policy that did away with more than 440 villages and countless human beings between 1982 and 1984, were all carried out on orders that filtered down through the military chain of command. Indian organizations in Guatemala are requesting that people throughout the world express solidarity with them by reading the following declaration in their respective languages over local radio and televsion stations: We, the people of _ __ [country, organization, community or Native nationality] express our anger and anguish over the massacre by the Guatemalan army of the people of Santiago Atitlan on the 2nd of December, 1990. We join with the orphans, widows, families and neighbors of those killed in cold blood to demand the immediate removal of the Army and National Police from Santiago Atitlan and that those responsible be brought to justice.
